Die Vorlesung richtet sich an Studenten im höheren Semester. Formale Teilnahmevoraussetzungen bestehen nicht; der vorherige Besuch der arbeitsrechtlichen Vorlesung zum Individualarbeitsrecht wird empfohlen.

Inhalt:

Bei der Vorlesung handelt es sich um eine Lehrveranstaltung mit dem Schwerpunkt Betriebsverfassungsrecht. Aktuelle tarifrechtliche Probleme werden behandelt und die Bezüge zum Individualarbeitsrecht hergestellt.
Einzelne Einheiten sind:

• Verhältnis Arbeitsvertragsrecht und Betriebsverfassungsrecht

• Gesetzesvorbehalt und Tarifvorrang

• Zusammensetzung und Wahl des Betriebsrats

• Verhältnis örtlicher Betriebsrat und Gesamtbetriebsrat

• Unterscheidung in Mitbestimmungsrechte und andere Beteiligungsformen

• Mitbestimmungsrechte des Betriebsrats in sozialen, personellen und wirtschaftlichen Angelegenheiten

• Unterrichtungs- und Beratungsrechte

Empfohlene Literatur:

ANWESENHEIT
Um diesen Kurs erfolgreich abzuschließen ist eine regelmäßige und aktive Teilnahme erforderlich. Welche Leistungen Sie während des Kurses erbringen müssen, um zur Abschlussprüfung zugelassen zu werden, erfahren Sie in der ersten Sitzung. Beachten Sie bitte, dass u.U. nicht alle prüfungsrelevanten Kursmaterialien über StudOn zur Verfügung gestellt werden. Die Teilnehmer sind selber verantwortlich, versäumte Sitzungen selbständig nachzuholen, fehlende Kursmaterialien zu besorgen, und Pflichtaufgaben ggf. nachzureichen.

PRÜFUNG
Die Abschlussklausur (schriftliche Prüfung, 90 Minuten) findet für alle Gruppen am Samstag, 24. Januar 2015 statt. Raum und Uhrzeit entnehmen Sie bitte dem Terminplan für die Abschlussklausuren, die ca. 4 Wochen nach Kursbeginn auf StudOn veröffentlicht wird. Eine Prüfungsanmeldung über mein campus ist erforderlich (Anmeldezeitraum 10. - 28. November 2014). Die Prüfungsnummer ist 30153.

LEISTUNGSNACHWEIS
Studierende, die diesen Kurs erfolgreich abschließen, erfüllen die Mindestanforderung der Prüfungsordnung (Nachweis der Fremdsprachenkompetenz) und erhalten eine entsprechende Bescheinigung zur Vorlage beim Landesjustizprüfungsamt, sofern diese noch nicht aufgrund einer bestandenen Prüfung in einer anderen Sprache ausgestellt wurde.

WIEDERHOLUNGSMÖGLICHKEIT / FOLGEN EINER NOCHT BESTANDENEN PRÜFUNG
Dieser Kurs wird jedes Semester angeboten. Eine nicht bestandene Prüfung muss wiederholt werden. Teilnehmer, die die Note 5,0 bekommen (= weniger als 50% der Punkte), müssen den gesamten Kurs wiederholen. Teilnehmer, die die Note 4,7 erreichen (= mindestens 50% der Punkte), dürfen die Prüfung zum nächsten regulären Termin (am Samstag, 11. Juli 2015) wiederholen, ohne den Kurs noch mal besuchen zu müssen. Teilnehmer müssen in diesem Fall unbedingt ihre(n) Kursleiter(in) kontaktieren, um die nicht-bestandene Prüfung einzusehen und zu besprechen. Wird die Prüfung in solchen Fällen nicht zum nächsten Termin abgelegt, muss danach der gesamte Kurs wiederholt werden. Eine Wiederholung zur Notenverbesserung ist ausgeschlossen.

Inhalt:

Der Kurs bietet den Teilnehmern eine Einführung in das anglo-amerikanische Rechtssystem, fördert den Erwerb grundlegender juristischer Fachterminologie, und vermittelt das entsprechende juristische Fachwissen.

Die Hauptthemen, mit denen sich die Kursteilnehmer beschäftigen werden, beziehen sich hauptsächlich auf Großbritannien und die USA, wobei andere englischsprachige Länder nicht ausgeschlossen werden.

Die Teilnehmer werden die wesentlichen Fachbegriffe aus Themenbereichen wie z.B. die Gerichte, die juristischen Berufe, Rechssystem und Verfassungsrecht erlernen. Rechtsvergleichend werden dabei in englischer Sprache auch verwandte Themen aus dem deutschen oder dem europäischen Recht behandelt.

Inhalt:

The law of obligations is the term used to group together two distinct fields of law: the law of torts and contract law.

This course focuses on the acquisition of the core legal terminology used in these two fields by learning about the fundamental legal principles in these areas. In addition to that, you will discover what procedures are involved in taking a civil case to court and the terminology employed in civil procedural law.

The course will place equal weighting on all the four language learning skills: reading, writing, listening and speaking.

Inhalt:

This course first introduces students to the terminology and procedures involved in bringing a criminal case to trial, the trial itself, the rules of evidence and how offenders are sentenced. Students will then study the basic concepts of substantive criminal law by looking at the elements of a crime, specific offences against property and crimes against the person and possible defences, as well as the language used in this field.

The course will place equal weighting on all of the four language learning skills: reading, writing, listening and speaking.

Inhalt:

Private Law A covers three separate areas of private law: company and commercial law, intellectual property and competition law.

In company and commercial law you will look at the formation of companies, consider the differences between German, English and American corporate structures, learn and use company-related vocabulary and terminology, discover what commercial law encompasses and the laws which govern it, and consider when relevant legislation such as the Sale of Goods Act (UK), the Uniform Commercial Code (USA) and the the European Convention on Contracts for the Sale of Goods (CISG) come into play.

Intellectual property covers the various protection rights such as copyright, patents, design rights and trademarks. You will look at these in the context of the commercial areas which they influence and consider some of the issues surrounding the protection of these rights through legislation and case law.

Competition law deals with the objectives of legal protection and the different areas of regulation concerning anti-competitive behaviour, also considering the relationship which exists between competition and IP law. You will identify the legislative instruments used to regulate anti-competitive behaviour in various jurisdictions and learn and utilise the legal terminology associated with this field of law.

Inhalt:

Private Law B covers four separate areas of private law: inheritance law, family law, employment law and property law.

1. In inheritance law you will look at what happens to a person’s property upon that person’s death, what is required for a will to be valid, the different legal approaches when a person dies with/without leaving a will, and learn and use related terminology in this field of law. An examination and comparison of the relevant legislative instruments used in both England and Germany is also covered together with cross -boarder issues.

2. Family law covers the law relating to family matters and you will be examining this in the context of marriage, divorce, parental responsibility and the rights of children. You will examine the courts which have family law jurisdiction and the legislation which guides them, as well as relevant case law in this area.

3. Employment law deals with the rights and obligations of employers and employees before, during and at the termination of employment, the tribunal system in the UK, considers the various anti-discrimination legislation in the EU, England and Germany, and covers the terminology used in this area of law.

4. Property law encompasses the laws concerning the acquisition, sharing and protection of valuable assets in England and Wales. You will look at this in the context of the four areas which fall into this field of law; land law, also known as ‘real property’, trust law, personal property and intellectual property, as well as learn and utilise topic specific terminology.

Inhalt:

This course focuses primarily on written work in legal and formal contexts. You will be expected to be able to use the general English and the legal lexis which you acquired in your earlier Level 2 and Level 3 courses in order to express yourself in writing more confidently and more fluently in legal and formal situations. This will include practice-orientated tasks such as writing legal correspondence, drafting legal documents for a case and writing case summaries.

This level 4 course is an advanced course and is part of the final stage of the law and language programme.

The course may only be attended by those law students who have already satisfactorily completed at least two level 3 law courses with good grades and ideally also at least one general course at level 3 or level 4.

COMBINATION WITH OTHER ENGLISH COURSES
You may attend this course and an additional level 3 law course and / or general English courses in the same semester. It is not possible to take both level 4 law courses in the same semester.

ATTENDANCE
Regular attendance and active participation are required in order to successfuly complete this course. Your teacher will inform you in the first session about any compulsory tasks that need to completed during the course as a prerequisite for being admitted to the final exam. Please be aware that not all materials relevant for the exam will necessarily be posted on StudOn and that participants are responsible for making sure that they catch up on any missed classes, acquire any additional materials and complete and/or submit any compulsory tasks.

ASSESSMENT
This course is assessed on the basis of both a written exam (translation) and an oral exam (interpreting). Your tutor will provide you with details of the exam and any other assessment requirements in the first week of the course.

REPEATING THE COURSE
Students who fail the exam and wish to retake it may do so at the end of the next semester without having to retake the whole course, providing they obtain the grade 4,7. Students who fail with the grade 5,0 must retake the whole course before being allowed to attempt the exam again.

Inhalt:

This course will help students to improve their English language skills in various fields of the law by confronting them with situations in which they will be required to switch effectively and quickly between German and English.

In the context of written texts, students will be expected to translate legal documents from and, in particular, into English. In addition to this, students will undertake interpreting exercises in which they will be expected to act as a linguistic mediator between a German-speaking party and an English-speaking party. The aim of the course is thus to practise the vocabulary acquired in the level 2 and level 3 courses in a situation where time is of the essence.

Inhalt:

The objective of this course is to develop and broaden students' business communication skills using a variety of tasks and project work.
Tasks include investment requests, dealing with complaints, "CSR statements" and mission statements to help develop the students’ use of tone and style in writing as well as writing appropriately for the audience and to achieve the desired goal.
Students will be asked to choose a business idea for which they will seek investment and to this end prepare a company file during the course which will count towards the final grade.

In diesem Kurs steht im Vordergrund die Vermittlung von juristischen Inhalten und der anglo-amerikanischen juristischen Fachsprache. Es werden verschiedene wesentliche Themenbereiche im Überblick behandelt (Grundzüge des anglo-amerikanischen Rechts, die Gerichte, Institutionen und Berufe, der Zivilprozess, Schuldrecht, Vertragsterminologie, Handels- und Gesellschaftsrecht, Recht des geistigen Eigentums). Alle vier Sprechfertigkeiten (Lesen, Schreiben, Hören, Sprechen) sollen geübt werden.

Fachsemester • Einstufungstestergebnis (Französisch für Hörer aller Fakultäten) von mindestens 60% Studenten, die im Einstufungstest weniger als 60% erreichten, dürfen auch an diesem Kurs teilnehmen, auch ohne den Test zu wiederholen, wenn sie mindestens einen der folgenden Kurse bestanden haben: Elementarkurs IV und Vertiefungskurs.
PRÜFUNG
Die Abschlussklausur ist eine schriftliche Prüfung. Sie dauert 90 minutes und findet am Ende des Semesters statt.
LEISTUNGSNACHWEIS
Studierende, die diesen Kurs erfolgreich abschliessen erfüllen die Mindestanforderung der Prüfungsordnung (Nachweis der Fremdsprachenkompetenz) und erhalten neben dem Leistungsnachweis auch eine entsprechende Bescheinigung zur Vorlage beim Landesjustizprüfungsamt.

Inhalt:

Eine allgemeine Einführung in das russische Rechtssystem und die russische Rechtssprache. Das Ziel ist es, einen Überblick über das russische Recht in den Bereichen Staatsrecht, Zivilrecht und Strafrecht bzw. über die juristischen Berufe in Russland zu schaffen. Die bereits vorhandenen Russischkenntnisse und der Wortschatz werden durch juristische Fachbegriffe erweitert, die sprachpraktische Kompetenzen werden verbessert.
